The warrant judge (Chief Judge Cha Eun-kyung) asked Yoon the only question at the Yoon Suk Yeol's review of the warrant. (1)The model for the military mobilization rebellion was the 5.16 military coup. In 1961, the 5.16 military group overthrew the constitutional civilian government and created an emergency body called the National Reconstruction Supreme Council, which was the supreme governing body with exclusive legislative and administrative powers. The National Reconstruction Supreme Council passed 1,008 laws in two and a half years. That's more than two-thirds of the law at the time. It called itself a "super-constitutional body," but it was, to be precise, an "illegal governing body" that clearly ran counter to constitutional, legal, and democratic.

(2) Park Chung-hee staged a Yushin pro-government coup in 1972 to dissolve the National Assembly. The president at the time had no right to dissolve the National Assembly, so it was a civil war crime in itself. He gave the <Emergency Council> legislative power and unilaterally passed various governing evil laws at the emergency council. Then, the Yushin National Assembly elections were held and the legislative power was returned to the National Assembly.

(3) Chun Doo-hwan expanded the May 17th emergency decree of 1980 across the country for military rule, created the National Security Emergency Response Committee, and operated it as the supreme governing body, just like Park Chung-hee's National Reconstruction Supreme Council. Then he created the National Security Council, and refined the legislation at the National Security Council a little bit and passed it. All of them are evil laws.

(4) They find it uncomfortable to think that these laws are unconstitutional. So the Constitutional Supplementary Provisions that came out immediately afterwards nailed the validity of the laws enacted and amended by the emergency legislative body. Nevertheless, since democratization in 1987, the laws of this emergency legislative body have been abolished or amended one by one through the passage of evil laws in the National Assembly and the unconstitutionality of the Constitutional Court. One of the criteria for the Constitution to determine whether it was unconstitutional was whether it was passed by the emergency legislative body. That's how bad law was the law of the emergency legislative body.

3. At this point, the emergency legislature has done as it pleases, and few people know the terminology. (I could write that because I analyzed the statute of the emergency legislation in my youth to overcome the law and the law, but it's not of interest to scholars today.) But I didn't expect a delusional president who wanted to take out and wield the dead relic "emergency legislation" in our constitutional cages and the "emergency martial law" that existed only in the constitutional provisions to come to life.

4. In short, the emergency legislative body Yun mentioned is the <National Reconstruction Supreme Council> <Emergency State Council> <National Security Legislative Council> created under military rule. In other words, he will completely ignore the National Assembly and exercise his legislative function with the president's iron fist. The idea of a martial law coup means that he will have the absolute power to legislate, administer, punish, and judge as he pleases. Yun once said, "Jeon Doo-hwan was still good at politics," and it is confirmed here that he meant it, and Yun's idea of an emergency legislative body is an example of copying Chun Doo-hwan.

5. When asked directly by the warrant judge, Yoon is only fumbling, unable to give a normal answer. He is at the heart of the rebellion. This is the kind of question you call " hit the nail on the head." -- JUST IN: Your Honor, that's great.
